  • Anyone work in HR?

    I have a dude who I'm pretty sure is talking constant shit and complaining any time I'm out of ear shot. If I have another employee who can verify that this is happening, can I fire that dude for being a shit bag... And it creating a hostile work environment.

    I just don't get these people that get a job working on a millionaire's show horse farm and then are SHOCKED that they're expected to, you know, work hard and keep things looking nice ...

      FWIW:

      New York is an at-will state, meaning that, but for one of the exceptions, all employees are considered at-will employees. This means that an employee can be fired without warning at any time for any reason or no reason at all. An employer's reason for terminating an at-will employee can seem unfair, unethical, or even immoral, but could still be deemed lawful.

          Unreal isn't it? That you would have to work at a job? Who would think such a thing.

          The big kicker, that you have to do shit work sometimes so that your boss can go do the work that requires knowledge, skill and/or common sense. How fucking lazy are managers for managing instead of laboring like the rest of us.

          It's been a crazy few weeks. The Gurals where up for memorial day getting their house ready is a task.. . I changed landscapers.. had to hire a new one and work out what he was going to do then get him started, I have a fence company I hired here replacing two fences, had a paving company come repair/repave the road, our construction contractors up for a bunch of leaks and more. The pest control company for carpenter bees... And more. That's all on top of the normal shit I have to do...


          This shit takes time yo. There is an hour or two a day AT LEAST I spend on the phone, computer, or in person ordering shit and dealing with shit. If I hire one company I've talked with and met with three...

          that's my job...


          This idiot thinks I should be out there with them with a tool in my hand, or I'm not working. And I'm starting to see the attitude of the "good" kid changing slowly.. it's not a good thing to have that going on.

            I like places where you can simply say, "You're fired." or "Your services are no longer needed. Pound sand.".

            I live in Washington that is "at will".

                  Do you pay through legitimate reporting? Meaning like a payroll, taxes, workers comp? If so then you might get forced into some kind of unemployment BS, just FYI. If not then launch him like an Iraqi SCUD missile.

                    We are employed by GFP Real Estate. It's a Manhattan based RE company on Park Ave.. we are as legit as legit gets.

                      Ah yeah so you definitely want to report it to your HR reps if that is the case then. I'd venture HR will at least want to keep some record of events in case it comes down to accusations of one sort another.

                        My $.02 when it comes to documentation of a poorly performing worker.
                        You have to document everything not just the bad stuff.
                        And you have to start documentation on your other employees as well so the loser you're firing can't say he was singled out.
                        I know it's a pain in the ass but that is what worked for me when I was a supervisor at a govt agency.

                          Hire everybody on a trial basis.

                          Hire an extra person so you always have someone to fire and the so the other employees see someone getting fired.

                          And most importantly, don't help anybody buy a shitbox for you to fix up for them.

                            I was going to write Parcs opinion. I find new blood and a little competition usually helps sort things out. If it doesn't, you fire a guy and don't end up short handed.

                            Always fire an employee because of a "cutback" and never for cause. There are several reasons for this, but mostly not going postal on you. The other guys will figure out what happened (or if they don't they'll probably be next).

                            Avoid talking shit to your guys about any employee ever, even after they're gone. You are the boss and that kind of talk is beneath you.
